# PRISTINE AUTO CARE

## TERMS AND CONDITIONS

Effective Date: 2 August 2026

### 1. INTRODUCTION

These Terms and Conditions ("Terms") govern the provision of automotive detailing, cleaning, paint enhancement, paint correction, protection and related services by Pristine Auto Care ("Pristine", "we", "us" or "our") to customers ("you", "your" or "Customer").

By making an enquiry, requesting a quote, making a booking, paying a deposit or invoice, providing a vehicle to us, or otherwise engaging our services, you acknowledge that you have had the opportunity to read and accept these Terms.

These Terms apply together with any applicable quotation, booking confirmation, invoice, service description or other written agreement issued by us.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or obligation that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law (ACL) or any other applicable legislation.

Where there is any inconsistency between these Terms and a non-excludable legal right, the applicable law will prevail.

# 2. SERVICES

### 2.1 Services Provided

Pristine provides automotive detailing and related services, which may include:

* exterior vehicle washing and detailing;

* interior cleaning and detailing;

* vacuuming and extraction;

* upholstery and carpet cleaning;

* stain treatment;

* pet hair removal;

* odour treatment;

* paint decontamination;

* paint enhancement;

* machine polishing;

* paint correction;

* ceramic and other protective coatings;

* spray sealants and waxes;

* glass cleaning and treatment;

* wheel and brake cleaning;

* tyre cleaning and dressing;

* engine bay cleaning;

* headlight restoration;

* trim and plastic treatment;

* leather and vinyl cleaning and protection;

* tar, adhesive and contaminant removal;

* mould and contamination treatment where reasonably safe and appropriate;

* and other automotive appearance services agreed with the Customer.

Not every service is suitable for every vehicle or material. We may decline or modify a service where we reasonably consider that proceeding would create an unacceptable risk of damage, injury or unsatisfactory results.

### 2.2 Service Descriptions

Service packages describe the general scope of work intended to be performed. The exact work undertaken may vary according to the vehicle's size, condition, materials, contamination and the package selected.

Unless expressly stated otherwise, a service is not a guaranteed restoration of the vehicle to a new, factory or concours condition.

### 2.3 Vehicle Condition and Service Suitability

The suitability and price of a service may depend on the actual condition of the vehicle.

Where the vehicle's condition materially differs from information provided at the time of booking, including where the vehicle has substantially greater contamination, staining, pet hair, mud, sand, rubbish, mould, odour, biological contamination or other conditions than disclosed, we may:

* recommend a more appropriate service;

* revise the scope of work;

* charge an additional amount;

* require approval for additional work; or

* decline or discontinue the service where appropriate.

We will, where reasonably practicable, discuss any material variation in price or scope with the Customer before proceeding.

### 2.4 Quotes and Estimates

Quotes and estimates are based on information supplied by the Customer and, where applicable, the condition of the vehicle observed during inspection.

Unless otherwise specified, quotes remain valid for fourteen (14) days.

A quote may be revised where:

* the vehicle differs materially from the condition described;

* additional work is requested;

* the scope of work changes;

* additional time, materials or specialist treatment are reasonably required; or

* circumstances outside our reasonable control affect the cost of providing the service.

A quote does not constitute a final agreement until accepted by both parties.

# 3. ADDITIONAL WORK AND VARIATIONS

### 3.1 Customer-Requested Additional Work

Additional services requested by the Customer after a booking has been confirmed may incur additional charges.

Where reasonably practicable, we will advise the Customer of the additional cost before performing the additional work and obtain approval.

### 3.2 Additional Work Identified During Service

We may identify conditions during the service that were not reasonably apparent from the original booking information.

Examples include:

* deeply embedded stains;

* excessive pet hair;

* heavy mud or sand;

* severe contamination;

* tar or adhesive contamination;

* significant odour sources;

* paint defects requiring additional polishing;

* damaged or deteriorated materials;

* mould or biological contamination;

* or other conditions requiring additional labour or specialist treatment.

We will seek Customer approval before undertaking material additional chargeable work wherever reasonably practicable.

If approval is declined, we may complete the originally agreed scope where reasonably possible, modify the service, or discontinue the affected portion of the work.

# 4. BOOKINGS

### 4.1 Making a Booking

Bookings may be made through our website, booking system, telephone, email, social media, in person or through any other booking method we make available.

A booking is not guaranteed until we have confirmed the booking and, where applicable, received any required deposit.

### 4.2 Booking Information

The Customer must provide accurate information when booking, including where relevant:

* vehicle make and model;

* vehicle size;

* vehicle condition;

* requested services;

* presence of excessive pet hair;

* significant staining;

* heavy mud or off-road contamination;

* mould or unusual contamination;

* known damage;

* and any other information reasonably relevant to performing the service.

Failure to provide accurate information may result in a revised quote, additional charges, a modified service or cancellation.

### 4.3 Arrival and Access

Customers must present the vehicle at the agreed time and location unless otherwise arranged.

Where the Customer is unable to provide the vehicle at the agreed time, the Customer should contact us as soon as reasonably practicable.

# 5. DEPOSITS, CANCELLATIONS AND RESCHEDULING

### 5.1 Deposits

We may require a deposit to secure a booking.

The required deposit amount will be disclosed to the Customer before or at the time of booking.

A deposit may be applied toward the final invoice unless otherwise stated.

### 5.2 Cancellation by Customer

Customers should provide as much notice as reasonably possible if they need to cancel or reschedule.

Where a Customer cancels with insufficient notice, repeatedly reschedules, fails to attend, or otherwise prevents us from reasonably filling the allocated appointment time, we may retain some or all of a deposit to the extent permitted by law and having regard to the circumstances and any reasonable loss incurred.

Any cancellation fee or deposit forfeiture applicable to a particular booking will be disclosed where reasonably practicable.

Nothing in this clause limits any rights the Customer may have under applicable law.

### 5.3 No-Show

If a Customer fails to present the vehicle for a confirmed booking without reasonable notice, the booking may be treated as a no-show.

A deposit may be retained, or a future booking may require a new deposit, subject to applicable law.

### 5.4 Rescheduling

We may permit a booking to be rescheduled subject to availability.

Repeated rescheduling may require a new deposit or payment arrangement.

### 5.5 Cancellation by Pristine

We may cancel or reschedule a booking where reasonably necessary, including due to:

* unsafe conditions;

* severe weather;

* equipment failure;

* illness or unavailability;

* vehicle condition;

* hazardous materials;

* inability to safely perform the requested service;

* or circumstances beyond our reasonable control.

Where we cancel a booking and have received a deposit for services that have not been provided, we will provide an appropriate refund or alternative arrangement, subject to applicable law.

# 6. PAYMENT

### 6.1 Payment Due

Unless otherwise agreed in writing, payment is due in full upon completion of the services and before the vehicle is released.

### 6.2 Payment Methods

We may accept:

* cash;

* electronic funds transfer;

* card payments;

* online payment methods;

* or other payment methods made available by Pristine.

### 6.3 Outstanding Amounts

Where payment is overdue, we may take reasonable steps to recover the outstanding amount, including issuing reminders or engaging a debt collection service where appropriate.

To the extent permitted by law, reasonable costs directly associated with recovering an overdue debt may be recoverable from the Customer where legally enforceable.

### 6.4 Vehicle Release

Where payment is due upon completion, we may delay release of the vehicle until payment has been received, subject to applicable law.

Nothing in this clause creates or purports to create a right to retain a vehicle where such a right does not otherwise exist.

### 6.5 GST

Unless otherwise stated, prices are quoted in Australian dollars.

Where applicable, GST will be charged in accordance with Australian taxation requirements.

# 7. VEHICLE ACCESS, KEYS AND SECURITY

### 7.1 Keys and Access Devices

Customers must provide all keys, remotes, access codes or other devices reasonably required to access or move the vehicle.

Customers should advise us of any special instructions relating to vehicle operation.

### 7.2 Vehicle Operation

Where reasonably necessary to perform the agreed service, we may move or operate the vehicle for purposes including:

* positioning;

* washing;

* detailing;

* inspection;

* photography;

* curing or drying;

* or other activities reasonably associated with the service.

We will take reasonable care when operating or moving the vehicle.

### 7.3 Known Mechanical or Electrical Issues

Customers must disclose known mechanical, electrical or operational problems that may affect the safe movement or operation of the vehicle.

We may decline to move or operate a vehicle where we reasonably consider doing so may create a safety or damage risk.

# 8. VEHICLE CONDITION AND CUSTOMER RESPONSIBILITIES

### 8.1 Disclosure of Existing Conditions

Before work begins, the Customer must disclose any known:

* damage;

* scratches;

* dents;

* chips;

* cracks;

* paint defects;

* rust;

* corrosion;

* leaks;

* mechanical faults;

* electrical faults;

* warning lights;

* aftermarket modifications;

* repaired or repainted areas;

* loose or damaged trim;

* broken clips;

* brittle plastics;

* damaged leather or upholstery;

* faulty seals;

* or other conditions that may be relevant to the service.

### 8.2 Personal Belongings

Customers should remove all personal belongings, valuables, documents, cash, electronic devices and other property before providing the vehicle.

Pristine is not responsible for loss of or damage to personal property left in the vehicle except to the extent liability cannot lawfully be excluded.

If personal belongings are encountered during the service, we may place them together in a safe location within the vehicle where reasonably practicable.

### 8.3 Vehicle Contents

We may decline to remove or handle dangerous, illegal, hazardous or highly valuable items.

We may also charge additional fees where excessive rubbish or personal property substantially increases the labour required to perform the agreed service.

### 8.4 Fuel and Vehicle Fluids

Vehicles must contain sufficient fuel for any agreed movement or operation.

Customers must disclose known fuel, oil, coolant, battery or other fluid leaks or restrictions.

# 9. PRE-SERVICE INSPECTION AND DOCUMENTATION

### 9.1 Inspection

We may inspect the vehicle before, during and after the service.

Inspection may include examination of:

* paintwork;

* wheels;

* tyres;

* glass;

* interior surfaces;

* upholstery;

* carpets;

* trim;

* plastics;

* lights;

* exterior panels;

* and other relevant areas.

### 9.2 Photography and Video

We may photograph or video the vehicle before, during and after the service for purposes including:

* documenting pre-existing damage;

* documenting vehicle condition;

* documenting service progress;

* quality control;

* training;

* dispute resolution;

* insurance documentation;

* and internal business records.

Where images contain identifiable personal information unrelated to the vehicle, we will handle that information in accordance with our privacy obligations and applicable privacy policy.

### 9.3 Existing Damage

Existing damage may be photographed and recorded before work begins.

Where reasonably practicable, we may notify the Customer of significant existing damage or conditions before commencing work.

The Customer acknowledges that detailing may expose, reveal or make more noticeable existing defects that were previously obscured by dirt, contamination or other material.

# 10. RESULTS, LIMITATIONS AND EXPECTATIONS

### 10.1 General Results

Detailing is intended to clean, enhance and protect the vehicle according to the agreed service.

Results vary according to:

* age;

* condition;

* material;

* previous maintenance;

* contamination;

* previous repairs;

* environmental exposure;

* depth of stains or scratches;

* quality of previous workmanship;

* and other factors.

No service guarantees that a vehicle will appear brand new or that every defect will be removed.

### 10.2 Stains and Contamination

Some stains, marks, dyes, oils, chemicals, biological contamination and embedded contaminants may be permanent or may not be safely removable without damaging the underlying material.

Attempting to remove certain contaminants completely may create a greater risk of damage. We may therefore stop treatment where further attempts would reasonably risk damaging the vehicle.

### 10.3 Odour Treatment

Odour treatment may reduce or eliminate many odours, but no guarantee can be given that every odour will be permanently removed.

Persistent odours may originate from sources within the vehicle that cannot be accessed or safely removed during the agreed service.

### 10.4 Pet Hair

Pet hair removal is dependent on the amount and location of the hair and the material involved.

Severe or embedded pet hair may require additional labour and charges.

### 10.5 Paint Enhancement and Polishing

Paint enhancement and polishing are intended to improve gloss, clarity and appearance.

They do not guarantee removal of all scratches, swirl marks, oxidation, water spots, etching, stone chips, dents or other paint defects.

Some defects may be too deep or severe to safely remove without substantially reducing paint thickness or requiring bodywork or repainting.

### 10.6 Paint Correction

Paint correction is a cosmetic improvement process and is not equivalent to panel repair or repainting.

We do not guarantee complete defect removal unless a specific level of correction has been expressly agreed in writing.

### 10.7 Headlight Restoration

Headlight restoration may improve clarity and appearance but does not guarantee restoration to factory-new condition.

The longevity of a restoration may depend on the condition of the lens, previous repairs, UV exposure, environmental conditions and subsequent maintenance.

### 10.8 Interior Materials

Leather, vinyl, plastics, fabrics, carpets, adhesives, trims and other interior materials can deteriorate with age and exposure.

Cleaning may reveal existing deterioration that was previously concealed.

We will take reasonable care but cannot guarantee against failure of materials that are already weakened, brittle, loose or deteriorated.

# 11. PRE-EXISTING DAMAGE AND DETERIORATED COMPONENTS

To the extent permitted by law, Pristine is not responsible for damage or deterioration that:

* existed before the vehicle was provided to us;

* resulted from age or normal wear and tear;

* resulted from previous repairs or modifications;

* resulted from poor-quality previous workmanship;

* resulted from deteriorated or weakened materials;

* was concealed or not reasonably observable before cleaning;

* or was caused by circumstances outside our reasonable control.

This includes, where applicable:

* existing scratches, chips, dents or paint defects;

* rust and corrosion;

* faded or oxidised paint;

* cracked or damaged headlights;

* cracked, faded or worn leather;

* damaged fabric or upholstery;

* brittle plastics;

* loose trim;

* broken clips;

* weakened adhesives;

* damaged buttons or switches;

* faulty seals;

* deteriorated electrical components;

* and other pre-existing defects.

The above does not exclude liability for damage caused by our negligence or failure to provide services with reasonable care and skill where such liability cannot lawfully be excluded.

# 12. DAMAGE DURING DETAILING

### 12.1 Reasonable Care

Pristine will perform services with reasonable care and skill.

### 12.2 Existing Weakness

Some cleaning and detailing processes require reasonable physical contact with surfaces and components.

Where a component is already weakened, cracked, brittle, loose, improperly repaired or deteriorated, it may fail during ordinary cleaning or handling.

We will take reasonable care to avoid causing damage.

### 12.3 Notification

If we identify damage during the service that appears to have occurred or become apparent during our work, we may document the condition and notify the Customer.

Where appropriate, we will investigate the circumstances and determine an appropriate response in accordance with applicable law.

# 13. HAZARDOUS MATERIALS, BIOHAZARDS AND UNSAFE VEHICLES

### 13.1 Disclosure

Customers must disclose any known:

* mould infestation;

* blood;

* bodily fluids;

* needles or sharps;

* animal waste;

* infestations;

* dangerous chemicals;

* hazardous substances;

* or other biological or environmental hazards.

### 13.2 Right to Refuse or Stop Work

We may refuse, suspend or stop work where a vehicle presents a health, safety or contamination risk to our staff, other customers, property or the surrounding environment.

This may include vehicles containing:

* significant mould;

* bodily fluids;

* needles or sharps;

* hazardous chemicals;

* active pest infestations;

* dangerous biological contamination;

* or other hazardous materials.

### 13.3 Specialist Treatment

Where specialist equipment, PPE, chemicals, disposal procedures or additional labour are required, additional charges may apply.

We will seek approval before proceeding with material additional chargeable work wherever reasonably practicable.

# 14. WATER, ELECTRICAL AND ENVIRONMENTAL CONDITIONS

Certain detailing processes involve water, electricity, pressure, chemicals and equipment.

We may modify, postpone or decline a service where weather, temperature, water availability, electrical conditions, site conditions or other environmental circumstances make the service unsafe or unsuitable.

Where a service is performed outdoors or in conditions outside our control, we cannot guarantee that environmental contamination will not subsequently affect the vehicle.

# 15. COATINGS, SEALANTS AND PROTECTIVE PRODUCTS

### 15.1 Product-Specific Requirements

Ceramic coatings, paint protection products, sealants, glass coatings and other protective treatments may have specific preparation, curing, maintenance and warranty requirements.

Customers must follow any maintenance instructions provided by Pristine or the relevant manufacturer.

### 15.2 Coating Durability

Any stated durability period is an estimate or manufacturer-rated expectation and is not a guarantee that the product will remain effective for the entire stated period.

Durability may be affected by:

* washing methods;

* chemicals;

* environmental exposure;

* storage;

* mileage;

* contamination;

* maintenance;

* weather;

* and other conditions.

### 15.3 Manufacturer Warranties

Where a product is supplied with a separate manufacturer's warranty, that warranty is subject to the manufacturer's terms.

Pristine does not guarantee that a manufacturer will approve a warranty claim.

Where Pristine provides its own service warranty, the terms of that warranty will be communicated separately.

# 16. WORKMANSHIP AND SERVICE CONCERNS

### 16.1 Reasonable Care and Skill

Pristine will provide services with reasonable care and skill and in accordance with the agreed scope of work.

### 16.2 Reporting Concerns

Customers should notify Pristine of any concern regarding completed work as soon as reasonably practicable, preferably within seven (7) days of completion.

Early notification allows us to inspect the vehicle while the relevant circumstances remain identifiable and, where appropriate, rectify an issue promptly.

Nothing in this clause limits any rights or remedies available to the Customer under Australian Consumer Law.

### 16.3 Inspection Before Remedy

Where a Customer raises a workmanship concern, Pristine may request an opportunity to inspect the vehicle before determining an appropriate remedy.

Where an issue is reasonably attributable to our workmanship, we may, subject to applicable law:

* rectify the affected work;

* repeat the affected service;

* provide an appropriate refund;

* provide a credit;

* or provide another appropriate remedy.

Customers should not arrange third-party repairs or treatments relating to an alleged workmanship issue before giving Pristine a reasonable opportunity to inspect the vehicle, except where urgent action is reasonably necessary.

# 17. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Pristine is not liable for loss or damage arising from:

* pre-existing defects;

* normal wear and tear;

* undisclosed damage or conditions;

* deterioration of aged or weakened materials;

* customer-supplied instructions that create a risk of damage;

* inaccurate or incomplete information provided by the Customer;

* personal belongings left in the vehicle;

* conditions outside our reasonable control;

* or the failure of a product or treatment to achieve a particular cosmetic result where the limitation was reasonably foreseeable or communicated.

Nothing in these Terms excludes liability that cannot legally be excluded, including rights and remedies available under the Australian Consumer Law.

# 18. CUSTOMER PROPERTY

The Customer remains responsible for removing valuable, sentimental, confidential or personal property from the vehicle before service.

Pristine is not responsible for property that the Customer chooses to leave in the vehicle except to the extent required by law.

If property is discovered during the service, we may move it to another location within the vehicle for safekeeping where reasonably practicable.

# 19. VEHICLE COLLECTION AND STORAGE

### 19.1 Collection

Customers must collect their vehicle at the agreed collection time or make alternative arrangements with Pristine.

### 19.2 Delayed Collection

Where a vehicle remains at our premises beyond the agreed collection time, we may charge a reasonable storage fee where such a fee has been disclosed or otherwise agreed.

### 19.3 Uncollected Vehicles

If a vehicle remains uncollected for an extended period, we may contact the Customer and provide reasonable notice requiring collection.

If the Customer fails to collect the vehicle or make suitable arrangements, we may take reasonable steps available under applicable law to recover outstanding amounts or arrange alternative storage.

Any sale, disposal or other enforcement action will only be undertaken where permitted by applicable law and following any required legal process.

# 20. CUSTOMER REQUESTS AND SPECIAL INSTRUCTIONS

Customers must communicate any special requirements before work commences.

This may include:

* areas not to be cleaned;

* products not to be used;

* concerns about sensitive materials;

* aftermarket modifications;

* vehicle-specific requirements;

* or other special instructions.

We will make reasonable efforts to accommodate legitimate instructions, but may decline instructions that would create an unreasonable safety, damage or service-quality risk.

# 21. THIRD-PARTY PRODUCTS AND SERVICES

Where products or services supplied by third parties are used, including coating products, cleaning chemicals, replacement items or specialist services, the relevant manufacturer's or supplier's terms may also apply.

Nothing in this clause limits any rights the Customer has against Pristine under applicable law.

# 22. PHOTOGRAPHS, MARKETING AND PRIVACY

### 22.1 Service Documentation

Pristine may take photographs or video of vehicles for documentation, quality control, insurance, training and dispute-resolution purposes.

### 22.2 Marketing Use

Where photographs or video are intended to be used publicly for marketing, advertising, social media, website content or promotional purposes, Pristine will take reasonable steps to avoid publishing identifiable personal information.

Where required, Customer consent will be obtained before using identifiable customer information for marketing purposes.

### 22.3 Privacy

Personal information collected by Pristine will be handled in accordance with our applicable Privacy Policy and Australian privacy requirements.

# 23. INTELLECTUAL PROPERTY

Any original photographs, videos, written material, branding, designs or other content created by Pristine remain the property of Pristine unless otherwise agreed in writing.

Customers must not reproduce or commercially use Pristine's branding, marketing material or original content without permission.

This clause does not affect ownership of photographs or other material supplied to us by the Customer.

# 24. FORCE MAJEURE

Pristine will not be responsible for delay or inability to perform services caused by circumstances reasonably outside our control.

Such circumstances may include:

* severe weather;

* natural disasters;

* power or water outages;

* equipment failure;

* supply shortages;

* serious illness;

* accidents;

* government restrictions;

* emergency situations;

* or other events that could not reasonably have been prevented or controlled.

Where reasonably practicable, we will notify the Customer and offer an alternative booking or other appropriate arrangement.

# 25. DISPUTES AND RESOLUTION

If a Customer has a concern or dispute, they should first contact Pristine and provide reasonable details of the issue.

We will endeavour to investigate and resolve genuine concerns fairly and promptly.

Customers should provide reasonable access to the vehicle where an inspection is necessary to investigate a complaint.

Nothing in this section prevents a Customer from exercising any legal right or remedy available under Australian law.

# 26. AUSTRALIAN CONSUMER LAW

Nothing in these Terms is intended to exclude, restrict or modify any guarantee, warranty, right or remedy that cannot legally be excluded under the Australian Consumer Law or other applicable legislation.

Where services supplied by Pristine fail to meet a consumer guarantee that applies to the services, the Customer may have rights and remedies under the Australian Consumer Law.

Any purported limitation in these Terms is subject to those rights.

# 27. CHANGES TO THESE TERMS

Pristine may update these Terms from time to time.

The Terms applying to a particular booking will generally be the Terms in effect and provided to the Customer at the time the booking is made, unless otherwise agreed or required by law.

Updated Terms will apply to future bookings from the stated effective date.

# 28. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down or severed to the extent necessary, and the remaining provisions will continue to operate to the extent permitted by law.

# 29. GOVERNING LAW

These Terms are governed by the laws of South Australia and applicable Commonwealth laws of Australia.

The parties submit to the applicable courts and tribunals of South Australia and Australia.

# 30. ACCEPTANCE

By booking, paying for or receiving services from Pristine Auto Care, the Customer acknowledges that they have had a reasonable opportunity to review these Terms and agrees that these Terms apply to the services provided, subject to any rights that cannot legally be excluded.
